Equity vs. Equality in American Society

On the surface, critical race theory, gender quotas, and race-based school admissions policies all represent popular trends in American discourse and public policy.

What lurks at their core, however, is a growing movement to replace the American ideal of equality among all individuals with the collectivist notion of equity through group entitlements, with government leading the charge.

Equality and equity are neither identical nor interchangeable, however. The so-called “equity” sought today is viewed through the lens of group membership, often classed by forbidden attributes such as race and sex.

The Constitution explicitly protects equality before the law from the very threat that equity poses—discrimination among individuals based on their membership in groups they didn’t choose.

Indeed, the focus on race is particularly prevalent in education, but drive for equity is spreading to government contracting and employment. Even freedom of thought isn’t immune—if it doesn’t align with the equity viewpoint.

If the push for equity succeeds, government will again institutionalize discrimination and turn back the civil rights imperative of treating each person as an individual.

Pacific Legal Foundation has been on the front lines of this battle. Join us on May 26 to explore this alarming spread of collectivism through race- and sex-based preferences in government and how we can fight back to restore and preserve equality before the law.
